TERMS OF SERVICE AGREEMENT

PLEASE READ THIS TERMS OF SERVICE AGREEMENT (“TOS”) CAREFULLY. BY ACCESSING OR USING THE WEBSITE OF ABEHINNYUEN COMMUNITY OF HOPE (ACOH), INC., YOU AGREE TO BE LEGALLY BOUND BY ALL TERMS AND CONDITIONS PROVIDED BELOW. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USE OF THE SITE AND ALL RELATED SERVICES IMMEDIATELY. USERS, CUSTOMERS, AND PROSPECTIVE CUSTOMERS ARE RESPONSIBLE FOR REVIEWING THESE TERMS PRIOR TO USING THE SITE.

1. ACCEPTANCE OF TERMS
This Terms of Service Agreement (“TOS”) is a legally binding contract between you (“User”) and ABEHINNYUEN COMMUNITY OF HOPE (ACOH), INC., located at 456 Van Duzer Street, Staten Island, NY 10304, including its subsidiaries, programs, and affiliated entities.

This Agreement governs your use of:

The ACOH website located at www.acohinc.org (“Site”),
-
Digital platforms, applications, and media associated with ACOH, and
-
Any other online services, content, or resources provided by ACOH (“Services”).
Your continued use of the Site constitutes full and unconditional acceptance of this Agreement.

2. DESCRIPTION OF WEBSITE SERVICES
The ACOH website serves as an informational and nonprofit resource offering:

Public information about community programs and initiatives
-
Educational content
-
Forms, documents, and digital resources
-
Online engagement tools and communication features
Users understand and agree that:

All Services, tools, features, and digital content are the exclusive property of ACOH.

ACOH reserves the unrestricted right to update, modify, add, or discontinue any Services without prior notice.

Continued use after such updates constitutes acceptance of any revised terms.
All Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind. ACOH does not guarantee uninterrupted access, error-free operation, or preservation of user content.

3. REGISTRATION REQUIREMENTS
Registration may be required for access to certain features. To create an account, you must:

Be 18 years of age or older,

Be legally eligible to receive services under applicable U.S. law,

Provide accurate, complete, and current information, and
-
Maintain this information by updating it as necessary.
Providing false, incomplete, or misleading information may result in suspension or permanent termination of your account.
Child Access Policy
Children under 13 years old may not create an account. They may only access the Site through a parent/guardian-managed family account.
The parent/guardian must:

Be at least 18 years old,

Supervise the child’s use at all times, and
-
Determine whether any content or service is age-appropriate.

4. PRIVACY POLICY
Your personal data is governed by the ACOH Online Privacy Policy.
By using the Site, you authorize:

Collection, storage, and processing of your data,

Transfer of your information within the United States, and

Use of your information as described in the Privacy Policy.
5. MEMBER ACCOUNT, USERNAME, PASSWORD, AND SECURITY
You are solely responsible for:

Maintaining confidentiality of your account credentials,

All activity conducted under your account, and
-
Promptly reporting any unauthorized access or security breach.
ACOH is not liable for losses or damages resulting from your failure to protect your account information.
6. USER CONDUCT
Users agree NOT to use the Site or Services to:
a. Upload, share, or transmit unlawful, defamatory, abusive, obscene, hateful, or otherwise objectionable content
b. Harm, exploit, or attempt to harm minors
c. Impersonate any individual or organization
d. Misrepresent affiliation with another group or entity
e. Violate copyrights, trademarks, patents, or other intellectual property rights
f. Upload malicious software, viruses, or harmful code
g. Conduct unauthorized advertising, spam, or solicitation
h. Interfere with normal communication flow or Site functionality
i. Violate local, state, national, or international law
j. Support, fund, or promote terrorist organizations
k. Harass, stalk, or threaten individuals
l. Collect personal data unlawfully or without consent
ACOH reserves the right to:

Pre-screen, block, or remove content,
-
Restrict or terminate accounts based on violations,
-
Disclose user information if required by law or to protect safety and property.
Unauthorized duplication, redistribution, or reproduction of Site materials is strictly prohibited.
7. INTERSTATE COMMUNICATION
Use of the Site may involve transmission of electronic data across multiple states. You consent to such transmission.
8. GLOBAL USE; EXPORT AND IMPORT COMPLIANCE
Users agree to comply with all U.S. and international export and import laws. You represent that you:

Are not restricted or prohibited under export control regulations,

Will not transfer restricted technologies to sanctioned countries,

Will not use the Services for weapons development or military purposes,

Will not upload or transmit materials that violate export/import laws.
9. CONTENT SUBMITTED TO THE SITE
You retain ownership of your content. However, by submitting content, you grant ACOH a non-exclusive, royalty-free, worldwide license to:

Use

Reproduce
-
Distribute
-
Modify
-
Display
…your content is solely for the operation, improvement, or promotion of the Services.
This license ends when you delete your content or terminate your membership, except where legal, archival, or operational requirements require otherwise.
Public areas include forums, message boards, and social spaces. Private areas include internal messaging and emails.
10. CONTRIBUTIONS TO THE WEBSITE
Suggestions, proposals, feedback, or ideas (“Contributions”) submitted to ACOH:

Are considered non-confidential,
-
May be used without obligation or compensation,
-
Become the permanent property of ACOH.
11. INDEMNITY
You agree to indemnify and hold harmless ACOH, its officers, employees, partners, and affiliates from any claims, damages, losses, liabilities, and attorney fees arising from:

Content you submit,
-
Violations of this TOS,
-
Infringement of third-party rights,
-
Misuse of the Site or Services.
12. COMMERCIAL REUSE OF SERVICES
You cannot reproduce, duplicate, sell, trade, resell, or exploit any part of the Site or Services for commercial or organizational gain without express written permission from ACOH.
13. USE AND STORAGE PRACTICES
ACOH may establish limits regarding:

Account storage capacity,

Number of messages or transactions,
-
Data retention periods,
-
Frequency and duration of account access.
Inactive accounts may be deleted, and ACOH is not responsible for failure to store or maintain user data.
14. MODIFICATIONS TO SERVICES
ACOH may modify, suspend, or discontinue any Service or feature at any time without notice. You agree that ACOH will not be liable to you or third parties for such modifications.
15. TERMINATION
You may terminate your account by contacting:

ACOH may suspend or terminate accounts due to:

Violation of any TOS provision

Law enforcement or legal requests

Security risks
-
Non-payment (if applicable)

Extended inactivity

Fraudulent or unlawful behavior

Service discontinuation
Termination may include:

Loss of Site access
-
Deletion of all account data
-
Future prohibition from using ACOH Services
16. ADVERTISERS
Interactions with third-party advertisers are strictly between you and the advertiser. ACOH is not responsible for any loss or damage resulting from such dealings.
17. LINKS TO THIRD-PARTY SITES
The Site may contain links to external websites. ACOH does not control or endorse external content and is not liable for:

Availability,
-
Accuracy,
-
Safety, or
-
Damages resulting from third-party sites.
Users access third-party links at their own risk.
18. PROPRIETARY RIGHTS
All ACOH content, including text, graphics, logos, software, multimedia, and design elements, is protected by U.S. and international intellectual property laws.
Unauthorized reproduction or misuse is strictly prohibited.
